ORDER DIRECTING PLAINTIFF TO PAY INITIAL PARTIAL FILING FEE AND DENYING MOTION FOR DISCOVERY - On December 20, 2021, the Court ordered the plaintiff to pay an initial partial filing fee of Fifty-Three Dollars and Seventy-Four Cents ($53.74) by January 20, 2022. Dkt. 6. That deadline has passed, and the plaintiff has failed to do so or otherwise respond. Therefore, the plaintiff shall have through February 28, 2022, to pay the initial partial filing fee or explain why doing so is not possible. The failure to do so by this date may result in the dismissal of this action without further warning. See 28 U.S.C. 1915(b)(1) (requiring court to assess and collect an initial partial filing fee). The plaintiff's motion for discovery, dkt. [ #3 ], is denied as unnecessary. The plaintiff does not request any discovery in the motion but rather explains the contents of the exhibits attached to his complaint. The plaintiff need not ask permission to file exhibits in support of a motion or pleading he has filed. Further, the plaintiff's complaint has not been screened, and no defendant has been served, so it is premature to request or send discovery. Copy to Plaintiff via US Mail. Order Granting Motion to Proceed In Forma Pauperis and Denying Without Prejudice Motion for Counsel - The plaintiff's motion to proceed in forma pauperis, dkt. #2 , is granted to the extent that the plaintiff is assessed an initial partial filing fee of Fifty-Three Dollars and Seventy-Four Cents ($53.74). The plaintiff shall have through January 20, 2022, in which to pay this sum to the clerk of the district court.
