Order on Motion to Proceed In Forma Pauperis - The plaintiff's motion to proceed in forma pauperis, dkt. #8 , is granted to the extent that the plaintiff is assessed an initial partial filing fee of Six Dollars and Ninety Cents ($6.90). See 28 U.S.C. 1915(b)(1). The plaintiff shall have through March 16, 2022, in which to pay this sum to the clerk of the district court. The plaintiff is informed that after the initial partial filing fee is paid, he will be obligated to make monthly payments of 20 percent of the preceding month's income each month that the amount in his account exceeds $10.00, until the full filing fee of $350.00 is paid. 28 U.S.C. 1915(b)(2). After the initial partial filing fee is received, a collection order will be issued to the plaintiff and the plaintiff's custodian, and the Court will screen the complaint in accordance with 28 U.S.C. 1915A. ORDER Granting Plaintiff's Motion to Separate Cases signed by Judge James R. Sweeney II on 12/28/2021 in Case No. 1:21-cv-0975-JRS-MPB. The clerk is directed to open one new civil action in the Indianapolis Division consistent with the following: 1) The plaintiff will be Danny Johnson. 2) The Nature of Suit will be 555. 3) The Cause of Action will be 42:1983pr. 4) The clerk is directed to redocket the complaint (docket 2) and this Order in the new action. 5) The assignment of judicial officers will be by random draw. 6) The defendants in the new action will be Cpt. Steven Hill and Lt. Brian Martz. The clerk shall redocket the complaint, dkt #2 in the new action. In this new action, the Court will screen the complaint pursuant to 28 U.S.C. 1915A, and Mr. Johnson will be required to pay the $402 filing fee or move for leave to proceed in forma pauperis.(DJH)
