Filing 4 ORDER - Dismissing Petition for Writ of Habeas Corpus,Directing Refund of Overpaid Filing Fees,and Directing Entry of Final Judgment; Christopher Lockett is in custody at Pendleton Correctional Facility. He was found guilty of a disciplinary infraction for attempted trafficking and sentenced to 30 days of segregation. He has filed a petition for writ of habeas corpus "challenging the disciplinary hearing board's determination of guilt." The motion to show cause, dkt. #2 , is granted to the extent that the Court has considered it in assessing Mr. Lockett's petition. But because Mr. Lockett does not challenge the fact or duration of his custody, the petition is dismissed for lack of jurisdiction. The petition for writ of habeas corpus is dismissed for lack of jurisdiction. Final judgment shall now enter. The Court notes that Mr. Lockett submitted $402.00 toward his filing fee, but the filing fee for a petition for writ of habeas corpus is only $5.00. The clerk is directed to issue Mr. Lockett a refund for overpayment of his filing fee. The clerk shall mail a Treasury check for $397.00 to Christopher Lockett at the following address.
