ENTRY DENYING #2 MOTION TO PROCEED IN FORMA PAUPERIS - On January 12, 2022, Plaintiff Jerry Wayne Mosley filed a Request to Proceed in District Court Without Prepaying the Filing Fee (Filing No. #2 ). The Plaintiff's Motion to proceed in forma pauperis, Filing No. #2 , is DENIED because he has sufficient income and/or resources to prepay the entire filing fee of $402.00. His Motion notes that he is employed, married, and has one dependent. He receives monthly wages in the amount of $800.00 as well as "VA retirement" in the amount of $3,480.00. Plaintiff further notes that his spouse is paid a monthly wage of $5,000.00. He explains that his monthly expenses total $4,600.00, which is less than the household income. The Plaintiff shall have through February 28, 2022, in which to pay the filing fee to the Clerk of the Court. Failure to do so may result in the dismissal of the action for failure to prosecute and failure to comply with Court orders. Copies sent pursuant to distribution list.
