Date Filed Document Text
May 12, 2022 Opinion or Order Filing 5 ORDER TO SHOW CAUSE - The Court previously notified Plaintiff that he had accumulated at least three "strikes" under 28 U.S.C. 1915(g) and therefore was ineligible to proceed in forma pauperis. The Court directed Plaintiff to pay the $402 filing fee by May 5, 2022. (ECF No. #4 .) Plaintiff has not paid the filing fee. Plaintiff is ordered to show cause by June 9, 2022, why this action should not be dismissed for failure to prosecute. The failure to show cause may result in the dismissal of this action without further notice. Copies sent pursuant to distribution list. Signed by Judge James R. Sweeney II on 5/12/2022. (AKH)
April 5, 2022 Opinion or Order Filing 4 Order Directing Further Proceedings - Plaintiff David Young, also known as Santa Fe, is an inmate at New Castle Correctional Facility. He filed a Complaint, (ECF No. 1), without prepaying the filing fee or seeking to proceed in forma pauperis. Under 28 U.S.C. 1915(g), a prisoner may not bring a civil action while proceeding in forma pauperis if the prisoner has, "on 3 or more prior occasions," brought an action in a court of the United States "that was dismissed on the grounds that it is frivolous, malicious, or fails to state a claim upon which relief may be granted, unless the prisoner is under imminent danger of serious physical injury." In an order issued by Judge Hanlon on May 7, 2020, Plaintiff was notified that he accumulated at least three "strikes" under 1915(g) and is therefore ineligible to proceed in forma pauperis. (See Young v. Sevier, No. 1:20-cv-761- JPH-TAB, at ECF No. 9 (S.D. Ind. May 7, 2020).) Further, Plaintiff does not indicate that he is "under imminent danger of serious physical injury," as his Complaint seeks compensation for uncashed checks. Therefore, Plaintiff must pay the $402 filing fee, and he has until May 5, 2022, to do so. (Copy to Plaintiff via U.S. mail) Signed by Judge James R. Sweeney II on 4/5/2022.(JDC)
