Filing 5 CLOSED JUDGMENT. ORDER - Presently pending before the Court are pro se Plaintiff Dante D. Guy's Complaint, [Filing No. 1], and Motion for Leave to Proceed In Forma Pauperis, [Filing No. 4]. This Order addresses Mr. Guy's motion and screens his Complaint pursuant to 28 U.S.C. 1915(e)(2). Mr. Guy's Motion to Proceed In Forma Pauperis, #4 , meets this standard and is therefore GRANTED. Pursuant to the Younger abstention doctrine, this action is STAYED pending the resolution of Case No. 49D32-2101-F4-001539 in the Marion County Superior Court and any related appellate proceedings; and The Clerk is DIRECTED to ADMINISTRATIVELY CLOSE this matter. If he wishes to reopen this case, Mr. Guy must file a motion to reopen this case within 60 days after the final disposition of Case No. 49D32-2101-F4-001539 and any related appeal. Filing 3 ORDER - A review of the docket in this case indicates that Plaintiff Dante Guy has neither paid the $402 filing fee nor filed a Motion to Proceed In Forma Pauperis. Mr. Guy shall have through April 22, 2022 in which to either: (1) pay the $402 filing fee for this action; or (2) demonstrate that he lacks the financial ability to do so by filing a Motion to Proceed In Forma Pauperis, indicating that he is unable to prepay the fee and stating his belief that he is entitled to redress. 28 U.S.C. 1915(a). Should Mr. Guy file a Motion to Proceed In Forma Pauperis, he must use the form attached as an exhibit to this Order. As stated on the attached form, Mr. Guy must also attach a printout of his prison trust account statement reflecting transactions for the six-month period immediately preceding the filing of his request and showing the current balance of his account. A failure to either pay the $402 filing fee by April 22, 2022 or to file a Motion to Proceed In Forma Pauperis by that date may result in the dismissal of this action.
