Filing 9 CLOSED JUDGMENT/FINAL JUDGMENT - The Court now enters FINAL JUDGMENT. The action is DISMISSED without prejudice. Copies to be sent pursuant to distribution list. Signed by Judge Jane Magnus-Stinson on 5/10/2022.(AKH) |
Filing 8 ORDER DIRECTING ENTRY OF FINAL JUDGMENT - The complaint was dismissed without prejudice at screening because it is barred by Heck and state court remedies have not been exhausted. Dkt. #6 at p. 3-4. Plaintiff was given a period of time to show cause why Judgment consistent with the dismissal of the complaint should not issue. Plaintiff then filed a motion for joinder of claims which does not address the dismissal of his complaint. Instead, Plaintiff asks the court to order that credit days be applied to a state court case number, immediate release from custody, and money damages. He names two additional defendants. These claims are deficient for the reasons noted in the screening Order. Accordingly, the motion for joinder of claims, dkt #7 , is DENIED. This action shall now be dismissed without prejudice and final Judgment shall enter. Copies sent pursuant to distribution list. Signed by Judge Jane Magnus-Stinson on 5/10/2022. (AKH) |
Filing 7 MOTION for Joinder of Claims, filed by Plaintiff MARK A. BONDS. (Attachments: #1 Envelope). (MAC) |
Filing 6 ORDER - Dismissing Complaint and Opportunity to Show Cause; Plaintiff Mark Bonds is a prisoner currently incarcerated at New Castle Correctional Facility. He filed this civil action seeking restoration of good time credit and money damages. Indiana does not permit judicial review of decisions by prison disciplinary bodies to revoke earned-time credits, but it does provide for judicial review of decisions related to the restoration of earned-time credits. There is no indication that Mr. Bonds presented his restoration challenge to the state courts before filing this petition. A dismissal for failure to exhaust is also without prejudice. The plaintiff's complaint must be dismissed for each of the reasons set forth. The plaintiff shall have through May 5, 2022, in which to show cause why Judgment consistent with this Entry should not issue. Show Cause Response due by 5/2/2022. Signed by Judge Jane Magnus-Stinson on 4/8/2022. *** SEE ORDER *** Copy Sent Via U.S. Mail to Plaintiff.(CKM) |
Filing 5 ORDER granting Plaintiff's #2 Motion for Leave to Proceed in forma pauperis to the extent that the plaintiff is assessed an initial partial filing fee of Two Dollars and Zero Cents ($2.00). See 28 U.S.C. 1915(b)(1). The plaintiff shall have through May 5, 2022, in which to pay this sum to the clerk of the district court. The plaintiff is informed that after the initial partial filing fee is paid, he will be obligated to make monthly payments of 20 percent of the preceding month's income each month that the amount in his account exceeds $10.00, until the full filing fee of $350.00 is paid. 28 U.S.C. 1915(b)(2). After the initial partial filing fee is received, a collection order will be issued to the plaintiff and the plaintiff's custodian. Copy to Plaintiff via U.S. Mail. Signed by Judge Jane Magnus-Stinson on 4/4/2022. (MAC) |
