ORDER Granting Motion for Order - The plaintiff's motion for order asks the Court to notify Clark County Jail that his case has been assigned a new case number and to direct the Jail to include the new case number when sending payments to the Court pursuant to the Collection Order issued on April 4, 2022, in case number 4:22-CV-00025-JMS-DML. The plaintiff's motion, dkt. #19 , is granted to the extent the Court confirms that case number 4:22-CV-00025-JMS-DML was transferred on May 6, 2022, and assigned a new case number: 1:22-cv-00899-JMS-DML. Order Screening Complaint and Directing Further Proceedings - #11 Motion for Collection Order and to Screen the Complaint is GRANTED to the extent that the Court previously issued a collection order, dkt. #12 , and this Order screens his complaint. The clerk is directed to update the docket to reflect that the defendant is CoreCivic and not "Community Corrections of America". Mr. Dorsey will be permitted a period of time in which to conduct discovery to learn the identity of the officers described in his complaint and of any other Jail personnel who could be properly named as defendants in this action. The clerk is directed to issue summons to the Jail Commander of Marion County Jail pursuant to Federal Rule of Civil Procedure 4(i)(2). The Marshal for this District is directed to serve the summons and complaint, with a copy of this Order, at the expense of the United States. Service may be made by certified mail. The clerk is directed to add the Marion County Jail Commander as an interested party on the docket. Mr. Dorsey shall have 45 calendar days after the Jail Commander responds to discovery in which to file an amended complaint, which will completely replace the original complaint. ORDER Directing Monthly Payments be made from Prison Account of JAYLON DORSEY - Plaintiff's custodian is directed to withhold sums from the inmate trust account of JAYLON DORSEY, and to forward such sums to the Clerk of this Court at 46 East Ohio Street, Room 105, Indianapolis, Indiana 46204, consistent with paragraph 2 of this Entry. The appropriate cause number, 4:22- CV-00025-JMS-DML, should be placed on each payment sent to the Clerk. The sums withheld and forwarded shall be twenty percent (20%) of the preceding month's income credited to the inmate's account. "Income" means all deposits including settlement proceeds, gifts, or bequests from family. Such sums shall be forwarded to the Clerk each time the amount in the inmate's account exceeds Ten Dollars ($10.00) until the filing fee is paid. As of the issuance of this Order, the balance of the filing fee still due in this case is $297.00. SEE ORDER. Copy to Plaintiff and Warden via US Mail.
