ORDER SCREENING COMPLAINT - Plaintiffs Robert Evans and Joshua Hall, by counsel, bring this action, alleging that the Indiana Department of Correction's policy of banning commercially produced photobooks with color photographs violates the First Amendment. They seek declaratory and injunctive relief. Because the plaintiffs are incarcerated, this Court has an obligation to screen the complaint before service on the defendant. Pursuant to 28 U.S.C. 1915A(b), the Court must dismiss the complaint if it is frivolous or malicious, fails to state a claim for relief, or seeks monetary relief against a defendant who is immune from such relief. In determining whether the complaint states a claim, the Court applies the same standard as when addressing a motion to dismiss. Based on the screening standard set forth above, the complaint shall proceed as presented. The clerk has issued the proposed summons attached to the complaint. Dkt. [4.] The plaintiffs shall complete service on the defendant consistent with Rule 4(m) of the Federal Rules of Civil Procedure. (See Order). Signed by Judge Jane Magnus-Stinson on 5/18/2022.(AKH)
