June 6, 2022 Opinion or Order Filing 3 Order Screening and Dismissing Complaint, and Directing Further Proceedings - Plaintiff David Young, an inmate at New Castle Correctional Facility, submitted a document titled "Lazy Judge Motion and Complaint Motion," that the Court has construed as a civil rights complaint pursuant to 42 U.S.C. 1983. Because Mr. Young has not paid the filing fee, this Court has an obligation under 28 U.S.C. 1915(e)(2) to screen his complaint. In summary, Mr. Young's complaint is dismissed for failure to state a claim upon which relief may be granted and because some of his claims are factually frivolous. Mr. Young has through July 5, 2022, to pay the $402.00 filing fee and show cause why judgment consistent with this Order should not issue. See Luevano v. Wal-Mart Stores, Inc., 722 F.3d 1014, 1022 (7th Cir. 2013) ("Without at least an opportunity to amend or to respond to an order to show cause, an IFP applicant's case could be tossed out of court without giving the applicant any timely notice or opportunity to be heard to clarify, contest, or simply request leave to amend.").
