ORDER DIRECTING PETITIONER TO SHOW CAUSE - Antonio Dickerson has filed a petition for a writ of habeas corpus challenging his pretrial detention in Bartholomew County Jail under Indiana Cause No. 03D01-2203-F4-1354. Mr. Dickerson's Fourth Amendment claim is not cognizable in a 2241 proceeding. Even in the context of a post-conviction 2254 proceeding, a habeas petitioner challenging his custody under the Fourth Amendment must show more than a mere constitutional violation; he must show that the state courts did not provide "an opportunity for full and fair litigation" of his Fourth Amendment claim. Mr. Dickerson's petition does not allege that he has raised a Fourth Amendment issue in his state court proceedings, let alone that the state court has denied him an "intellectually honest" decision. Mr. Dickerson has through September 5, 2022, to show cause why his petition should not be dismissed. Failure to meet this deadline will result in dismissal of the action without further warning.
