Date Filed Document Text
September 2, 2022 Opinion or Order Filing 9 CLOSED JUDGMENT/Final Judgment - Pursuant to the Order also issued this day, the Court vacates the order issued on June 14, 2022, by the Delaware Circuit Court, Case No. 18C05-2009- CT-000089, and quashes the subpoena issued from that court by counsel, Renee L. Scott-Mitchell, seeking to subpoena certain information from the IRS. The Court, having granted that relief, retains no further jurisdiction under 28 U.S.C. 1442. The Court directs the Clerk to close the federal case. This is a final judgment under Federal Rule of Civil Procedure 58. This case is closed. Signed by Judge James R. Sweeney II on 9/2/2022.(JDC)
September 2, 2022 Opinion or Order Filing 8 ORDER granting #3 Motion to Quash; granting #3 MOTION to Quash Subpoena Duces Tecum MOTION to Vacate State Court Order. The Court notes with approval that the IRS has communicated with Columbia's counsel to help them with the applicable regulations and processes for obtaining IRS records in non-IRS matters. (Br. Supp. Mot. 6 n.2, ECF No. 4.) That might hav e been the expedient course of action in the first instance; in any case, the Court hopes that the underlying discovery dispute may now swiftly be resolved. The relief granted above exhausts the Court's limited 28 U.S.C. 1442 jurisdiction over the matter, so this Order disposes of the federal case. Final judgment shall issue separately. Signed by Judge James R. Sweeney II on 9/2/2022. (JDC)
