In light of this conference, the Court now makes the following rulings and directs further proceedings: (1) Discovery. The Court will permit a brief period of 21 days, beginning September 19, 2022, and closing on October 10, 2022, for the parties to engage in limited discovery regarding Mr. Wilson's placement in protective custody. Plaintiff's counsel is directed to serve a formal discovery request, narrowed in time frame and scope, on the Defendants by Monday, September 19, 2022. August 22, 2022 Opinion or Order Filing 7 ORDER: Plaintiff Robert Wilson, by counsel, filed this civil rights action pursuant to 42 U.S.C. 1983 today, August 22, 2022. Dkt. 1. Mr. Wilson contemporaneously filed an emergency motion for temporary restraining order stating that he faces imminent danger at Pendleton Correctional Facility. Specifically, Mr. Wilson has been threatened and expects to be physically attacked in the very near future.Given the serious allegations raised, the assigned Magistrate Judge is requested to hold a telephonic status conference as soon as practicable.The Court ORDERS that Mr. Wilson be placed in protective custody immediately.Given the nature of the allegations made in the complaint and emergency motion for relief, a copy of the complaint (docket 1), the motion for temporary restraining order (docket 2), and a copy of this Order shall be sent to Chris Ertel, Deputy Warden of Operations at Pendleton Correctional Facility, and Diana Moers, Section Chief for the Government Litigation Section of the Indiana Attorney General.
