Filing 7 Order Screening Complaint and Directing Further Proceedings - Plaintiff Michale Coleman is a pretrial detainee currently incarcerated at the Bartholomew County Jail ("BCJ"). He filed this civil action alleging that he is subjected to unconstitutional conditions of confinement and cannot practice his religion. Mr. Coleman had filed his complaint in state court, but the defendant removed the action to this Court. Dkt. #1 . Because Mr. Coleman is incarcerated, this Court must screen the complaint. This summary of claims includes all of the viable claims identified by the Court. All other claims have been dismissed. If Mr. Coleman believes that additional claims were alleged in the complaint, but not identified by the Court, he shall have through October 31, 2022, in which to identify those claims. The clerk is directed to docket the exhibit at docket [1-2] as the complaint in this action. The defendant has been served, and counsel has appeared on his behalf, so no service of process is necessary. Mr. Coleman's negligence, Fourteenth Amendment conditions-of-confinement, First Amendment religious practice, and RLUIPA claims shall proceed against Sheriff Myers in his official capacity. All other claims are dismissed. Nothing in this Order prohibits the filing of a proper motion pursuant to Rule 12 of the Federal Rules of Civil Procedure. (See Order.)
