November 3, 2022 Filing 8 CLOSED FINAL JUDGMENT - The Court now enters final judgment. This action is dismissed without prejudice. Signed by Judge Sarah Evans Barker on 11/3/2022. Copy to Plaintiff via US Mail. (DWH)
November 3, 2022 Opinion or Order Filing 7 ORDER DISMISSING ACTION AS DUPLICATIVE - This case involves the same claims and parties as those in Coleman v. Myers, 1:22-cv-1883-JRS-DML, filed in this court on September 23, 2022. There is no reason for duplicative lawsuits which drain scarce judicial resources. Accordingly, this action is dismissed without prejudice. Mr. Coleman's motion for leave to proceed in forma pauperis, dkt. #2 , and motion for magistrate judge, dkt. #4 , are denied as moot. The Court notes this is not Mr. Coleman's first duplicative action recently brought in this Court. See Coleman v. Myers, No. 1:22-cv-2033-RLY-MJD, dkt. 6 (S.D. Ind. Oct. 25, 2022) (dismissing action as duplicative); Coleman v. Myers, No. 1:22-cv-1942-TWP-TAB, dkt. 13 (S.D. Ind. Oct. 21, 2022) (same). This practice gives no benefit to Mr. Coleman, and further duplicative actions may result in sanctions. Final judgment shall now issue (SEE ORDER). Signed by Judge Sarah Evans Barker on 11/3/2022. Copy to Plaintiff via US Mail. (DWH)
