Filing 9 ORDER DISMISSING ACTION - For the reasons discussed above, this action is DISMISSED with PREJUDICE in its entirety because the defendants are immune and Plaintiff has failed to state a claim on which relief can be granted. Plaintiff's motion for injunctive relief is DENIED as MOOT. Plaintiff has already been warned twice that his pattern of prior litigation is not welcome in this Court. See Easterling v. Lakefront Lines, Inc., No. 1:22-cv-01759-JMS-TAB (Sept. 15, 2022); Easterling v. Miami Valley Regional Transit Auth., No. 1:22-cv-02166-SEB-MPB (Nov. 14, 2022). Nevertheless, he continues to file frivolous lawsuits and documents in closed cases. "Federal courts have both the inherent power and constitutional obligation to protect their jurisdiction from conduct which impairs their ability to carry out Article III functions." In re McDonald, 489 U.S. 180, 184 (1989)). In light of Plaintiff's continued filing practices in this Court and his disregard of prior warnings, the Clerk is now directed to refer the matter of Plaintiff's filing practices to the Chief Judge for whatever action she deems warranted.
