Filing 10 RECEIPT #2999 for filing fee in the amount of $18.53, paid by PAUL LESTER CARMOUCHE, JR.. (DRB) |
Filing 9 ORDER GRANTING MOTION FOR INFORMATION - The plaintiff sent a letter to the Court that has been construed as a motion for information and notice of status of filing fee. Dkt. 8. The plaintiff informs the Court that he submitted a request for remittance on December 2, 2022, to pay his initial partial filing fee. The plaintiff asks if he can submit an additional exhibit in support of his complaint. The motion, dkt. [ #8 ], is granted to the extent that the plaintiff may file a motion to add exhibits in support of his complaint before the Court screens the complaint. However, the Court observes that it is not necessary for the plaintiff to do so. While the Court may consider documents attached to a complaint, it is the plaintiff's burden to plead a short and plain statement of the claim in the complaint itself. Fed. R. Civ. P. 8(a)(2); Williamson v. Curran, 714 F.3d 432, 436 (7th Cir. 2013). If the plaintiff does not submit the additional exhibits, the Court will screen his complaint and will consider the previously submitted exhibits in support thereof, see dkts. 1, 1-1, 1-2, and 1-3, once the Court receives the initial partial filing fee. Copy to Plaintiff via US Mail. Signed by Magistrate Judge Tim A. Baker on 12/12/2022. (SWM) |

The plaintiff is informed that after the initial partial filing fee is paid, he will be obligated to make monthly payments of 20 percent of the preceding month's income each month that the amount in his account exceeds $10.00, until the full filing fee of $350.00 is paid. 28 U.S.C. 1915(b)(2). After the initial partial filing fee is received, a collection order will be issued to the plaintiff and the plaintiff's custodian, and the Court will screen the complaint in accordance with 28 U.S.C. 1915A. The clerk is directed to seal the motion to proceed in forma pauperis, dkt. #2 , because it names the plaintiff's minor daughter. Fed. R. Civ. P. 5.2(a).
