ORDER Correcting Summons and Service - In a previous Order, (ECF No. #10 ), this Court inadvertently ordered the Marshal for this District or his Deputy to serve the defendants in the lawsuit, without first providing the defendants an opportunity to waive service. That Order, (ECF No. #10 ) is hereby vacated. The clerk is designated to issue process to Fernando Cervantes and Sydnie Hensel in the manner specified by Rule 4(d). Process shall consist of the Complaint (ECF No. 1), applicable forms (Notice of Lawsuit and Request for Waiver of Service of Summons and Waiver of Service of Summons), and this Entry. The defendants will have until February 6, 2023, to return the Waiver of Service. If the Waiver of Service is not returned, then the Court will order the Marshal for this District or his Deputy to serve the defendants at their expense.
