ORDER - On December 26, 2022, this Court entered an Order directing Bartholomew County Sheriff Matthew Myers or his designee at the Bartholomew County Jail to provide the Court with a certified copy of Plaintiff David Lee's trust account statement or the Bartholomew County Jail's institutional equivalent for the six-month period preceding the filing of this action, and to do so no later than January 5, 2023. Dkt. 5. That deadline has passed, and Sheriff Myers has not complied with the Court's Order. IT IS HEREBY ORDERED that BARTHOLOMEW COUNTY SHERIFF MATTHEW MYERS or his designee, appear telephonically on January 31, 2023, at 1:30 p.m. (Eastern) before Magistrate Judge Kellie M. Barr and show cause, if there be any, for his failure to provide a trust account statement for Mr. Lee for the six-month period preceding the filing of this action. BARTHOLOMEW COUNTY SHERIFF MATTHEW MYERS or his designee is to call 888-363-4734 to participate in the Show Cause Hearing. ORDER Directing Plaintiff's Custodian to Forward Certified Copy of Inmate Trust Account Statement - The Court hereby ORDERS Sheriff Matthew Myers or his designee at the Bartholomew County Jail to provide the Court with a certified copy of Mr. Lee's trust account statement or the Bartholomew County Jail's institutional equivalent for the six-month period preceding the filing of this action on November 30, 2022, and to do so no later than January 5, 2023. The trust account statement should be submitted to the Clerk of the Court and should reference case number No. 1:22-cv-2310-JPH-KMB. Upon receipt of the required statement, the Court will assess what initial partial filing fee must be paid, if any, and whether a collection order should be entered to collect the filing fee (see Order for additional information).
