CASTRO NOTICE - This matter is before the Court to provide Petitioner Terrance Ferguson with Notice concerning the treatment of his recent filing in Case No. 1:20-cr-0009-TWP-TAB, which the Court determined to be a Motion for Relief under 28 U.S.C. 2255. In particular, the Court determined that the filing of the motion arguing his trial counsel was ineffective falls within the scope of 2255. (Dkt. 2). Accordingly, the Court directed that the post-judgment motion be treated as such and directed opening of the instant case, a new civil action. This Order provides the Ferguson with his notice of the treatment of his post-judgment filing and his opportunity to withdraw or amend the motion. He shall have through January 13, 2023 in which to either supplement his motion filed on December 2, 2022 with a complete statement of the claims and grounds on which he could and does challenge his conviction and/or sentence or withdraw such motion insofar as it could be thought to seek relief. He may, in the alternative, notify the court that the filing of December 2, 2022 does constitute a complete statement of the claims and grounds on which he could and does challenge his conviction and/or sentence. If he does not take one of these steps by January 13, 2023, the motion will be treated as a 2255 motion and the case will proceed. The clerk shall include a form 2255 motion with the petitioner's copy of this Order. The Clerk shall also show this case as a related case to 1:20-cr-00092-TWP-TAB-1. (See Order).
