ORDER DISMISSING ACTION AS DUPLICATIVE AND DIRECTING ENTRY OF FINAL JUDGMENT - Plaintiff Adrian Edwards, an Indiana Department of Correction inmate, brings this civil action based on allegations that the water at Pendleton Correctional Facility is contaminated and unsafe. Dkt. #1 . Mr. Edwards claims that he was and continues to be exposed to the contaminated water. Mr. Edwards asserted substantially similar allegations against the same defendants in an earlier case he filed on December 7, 2022. See Edwards v. Holcomb et al., No. 1:22-cv-02357-JPH-MPB (S.D. Ind. 2022) (Dkt. #1 ). The allegations, claims, and relief sought in this case and the first filed action are not materially different. Accordingly, this action is DISMISSED without prejudice as duplicative of the first filed action. Mr. Edwards' motion for leave to proceed in forma pauperis, filed in this action, on January 4, 2023, dkt. #8 , is therefore DENIED as MOOT. The clerk is DIRECTED to docket a copy of Mr. Edwards' motion for leave to proceed in forma pauperis and supporting exhibit in the first filed action, Edwards v. Holcomb et al., No. 1:22-cv-02357-JPH-MPB. The Court will issue its ruling on Mr. Edwards' in forma pauperis status in the first filed action, in due course.
