Filing 9 Order Directing Entry of Final Judgment - Plaintiff Marshall Cobb, Sr., is a prisoner currently incarcerated at New Castle Correctional Facility. He alleges in this civil action that the defendants have imprisoned him even though he is innocent. Dkt. #1 . On December 19, 2022, the Court ordered him to show cause why this action should not be dismissed because his claims are barred by Heck v. Humphrey, 512 U.S. 477 (1994). Dkt. #5 . Mr. Cobb responded, but his response does not demonstrate that his claims are not Heck-barred. Dkt. #7 . This action is properly dismissed without prejudice. Final Judgment shall now enter.
