January 6, 2023 Opinion or Order Filing 3 Order Providing Castro Notice, Ordering Petitioner to Show Cause Why 2255 Motion Should Proceed Despite Being Untimely, and Summarily Denying Motion for Identity Hearing - Mr. Barnett's motion for an identity hearing, dkt. #2 , is summarily denied, and the clerk is directed to lift the ex parte restriction on Mr. Barnett's motion. Mr. Barnett has previously been warned about making such frivolous filings. Criminal Case, dkt. 54, and he is again warned that if he persists in filing frivolous motions, letters, or notices that he will be restricted from making future filings. In addition, Mr. Barnett shall have up to and including February 3, 2023, to respond to the Court's Castro Notice and--if he chooses to proceed with his 2255 motion--to show why this action should proceed even though it is untimely. If he does not respond to the Castro Notice by February 3, 2023, the motion will be treated as a 2255 motion and the case will proceed. If Mr. Barnett chooses to proceed with his 2255 motion and he does not show why this action should proceed even though it is untimely by February 3, 2023, his 2255 motion will be dismissed as untimely.
