Order Granting Motion for Reconsideration and Directing Plaintiff to Pay Filing Fee - The motion to reconsider, dkt. #5 , is granted to the extent that this civil action will proceed on Mr. Kreilein's amended complaint. The clerk is directed to change the nature of suit for this action to "550 Prisoner: Civil Rights." Mr. Kreilein has not paid any filing fee for this action. He shall have through April 21, 2023, to either pay the $402 filing fee or demonstrate his inability to do so by filing a motion for leave to proceed in forma pauperis in compliance with 28 U.S.C. 1915. Order Striking Petition and Directing Petitioner to File Amended Petition or Complaint - Mr. Kreilein's petition does not comply with the local rule and does not clearly state the basis for habeas relief. The petition, dkt. #1 , is therefore STRICKEN. To assist Mr. Kreilein with properly filing a 2254 petition, the Court will provide him with a form petition for a writ of habeas corpus. The clerk is directed to send to Mr. Kreilein a form petition along with his copy of this Order. Mr. Kreilein shall file an amended petition using that form by no later than April 3, 2023. Failure to file an amended petition using the Court's provided form by this deadline will result in the dismissal of this action without further warning or opportunity to show cause. (See Order.)
