ORDER DENYING #2 MOTION FOR LEAVE TO PROCEED IN FORMA PAUPERIS AND DIRECTING PLAINTIFF TO SHOW CAUSE - Julian Kyle Myers brought this action while in custody at the Decatur County Jail. He did not prepay the filing fee but instead moved for leave to proceed in forma pauperis. Dkt. #2 . Mr. Myers did not include a copy of his trust fund account statement with his motion for leave to proceed in forma pauperis. Accordingly, his motion for leave to proceed in forma pauperis, dkt. #2 , is DENIED without prejudice. Mr. Myers shall have through April 3, 2023, to pay the $402 filing fee for this action or renew his motion for leave to proceed in forma pauperis and attach a copy of his jail trust fund account statement. Additionally, it appears Mr. Myers is no longer in custody at the Decatur County Jail, and he has not updated his address with the Court. See dkt. #6 (returned mail); dkt. #7 (same). Mr. Myers shall have through April 3, 2023, to show cause why this action should not be dismissed for failure to prosecute and failure to pay the filing fee. Mr. Myers may satisfy the order to show cause by filing a Notice to the Court including his new address. Failure to comply with this deadline will result in dismissal of this action without further notice or opportunity to show cause. Copies sent pursuant to distribution list. (See Order).
