ORDER SCREENING COMPLAINT, DIRECTING SERVICE OF PROCESS, REQUESTING MAGISTRATE JUDGE TO SET STATUS CONFERENCE, AND DIRECTING PLAINTIFF TO PAY FILING FEE - March 7, 2023 Plaintiff Keandre Arnold, an inmate in the Indiana Department of Corrections, filed the instant Motion for Temporary Restraining Order and Preliminary Injunction with Memorandum of law in support of Motion (Dkt. #1 ). An action cannot be started with a motion, accordingly, the motion (Dkt. #1 ), is treated as complaint. Mr. Arnold shall have through April 4, 2023, in which to either pay the $402.00 filing fee for this action or demonstrate that he lacks the financial ability to do so. The clerk is DIRECTED to include a form motion with Mr. Arnold's copy of this Order. Because Mr. Arnold is a "prisoner," this Court has an obligation to screen the complaint before service on the defendants. If Mr. Arnold believes that additional claims were alleged in the complaint or seeks to assert additional properly joined claims, he shall have through April 10, 2023, in which to file an amended complaint. The clerk is DIRECTED to include a form complaint with Mr. Arnold's copy of this Order. The clerk is DIRECTED to issue process to the defendants. Process shall consist of the complaint (dkt. #1 ), applicable forms (Notice of Lawsuit and Request for Waiver of Service of Summons and Waiver of Service of Summons), and this Order. Defendant Dr. Keris is presumed to be an employee of Centurion. The clerk is DIRECTED to serve Dr. Keris electronically. A copy of this Order and the process documents shall also be served on Centurion electronically. Centurion is ORDERED to provide the full name and last known home address of Dr. Keris if Dr. Keris does not waive service if they have such information. This information may be provided to the Court informally or may be filed ex parte. The clerk is DIRECTED to provide courtesy copies of the service documents via email to attorneys Jeb Crandall and Adam Forrest. Counsel is ordered to appear for the limited purpose of addressing the allegations made in the motion for preliminary injunction. The clerk is DIRECTED to re-docket the complaint, dkt. #1 , as a motion for preliminary injunction and temporary restraining order, and to include a form complaint and in forma pauperis motion with Mr. Arnold's copy of this Order. Given the nature of Mr. Arnold's claims and the immediacy of the harm alleged, the Magistrate Judge is requested to set this matter for a telephonic conference at his earliest convenience. Defendants' counsel must endeavor to confer with their clients before the conference so that the parties can meaningfully address Mr. Arnold's allegations. (See Order).
