ENTRY Regarding Service of Notice of Deficiency and Order Directing Further Action - It has come to the Court's attention that the Notice of Deficiency and Order Directing Further Action (Dkt. 7) was mailed to pro se Plaintiff, who is a prison inmate, at the correct address, but then he was transferred to a different facility before he received the Court's Notice. The Notice was returned to the Court as undeliverable (see Dkt. 9). The Clerk is directed to mail again the Notice (Dkt. 7) to Plaintiff at the following address (see Entry). Plaintiff shall have through Friday, June 9, 2023, to correct the deficiency noted in the Notice of Deficiency (Dkt. 7). Failure to do so may result in the dismissal of the action for failure to prosecute and failure to comply with Court orders. Copies to Plaintiff via US Mail. | Filing 7 NOTICE OF DEFICIENCY - This matter is before the Court on Plaintiff's "Prisoner Motion to Proceed in Forma Pauperis" (Dkt. #2 ). Attached to the Motion is a one-page "Resident Account Statement," noting transactions from a four-day period from December 25 through 29, 2022. Your motion to proceed in forma pauperis cannot be ruled upon because you have not submitted a copy of the transaction history associated with your institution trust account for the six-month period preceding the filing of this action on March 16, 2023. Plaintiff shall pay the $402.00 filing fee to the Clerk of the District Court or submit the necessary transaction history by April 28, 2023. Failure to either pay the filing fee or respond and file the appropriate document by this deadline will result in dismissal of this action without further notice.
