ORDER Denying Motion to Appoint Counsel and Directing Entry of Final Judgment - This action is dismissed for failure to state a claim. The Order of May 8, 2023, dismissed the operative complaint and provided the plaintiff a period of time in which to show cause why this action should not be dismissed. Dkt. 6. The plaintiff has not responded and the time to do so has passed. Therefore, this action is properly dismissed for failure to state a claim upon which relief can be granted. 28 U.S.C. 1915A(b)(1). Any state law legal malpractice claim is dismissed without prejudice. Judgment dismissing this action shall now issue. In addition, the plaintiff's motion to appoint counsel states that plaintiff needs assistance to comply with Rule 7.1. But the plaintiff is not required to file a disclosure statement under that Rule. Therefore, his motion to appoint counsel, dkt. [ #6 ], is denied. Copy to Plaintiff via US Mail.
