CLOSED TRANSFER/ORDER TRANSFERRING ACTION TO NORTHERN DISTRICT OF INDIANA - Mario J. Sanchez, a prisoner confined at New Castle Correctional Facility, brings this lawsuit against La Porte County, Indiana, and La Porte County Circuit Judge Thomas J. Aleivos. The allegations set forth in the complaint occurred in La Porte County, Indiana. (Docket Entry 1). When jurisdiction is not founded solely on diversity, venue is proper only in the district where (1) any defendant resides, if all the defendants reside in the same state, (2) a substantial part of the events or omissions giving rise to the claim occurred, or a substantial part of property that is the subject of the action is situated, or (3) any defendant may be found, if there is no district in which the action may otherwise be brought. 28 U.S.C. 1391(b). La Porte County, Indiana is located in the South Bend Division of the Northern District of Indiana. 28 U.S.C. 94(a)(2). Venue is proper in the Northern District of Indiana, because that is where all the defendants reside or may be located and where the events or omissions giving rise to the claims occurred. Accordingly, the clerk is directed to transfer this action to the South Bend Division of the United States District Court for the Northern District of Indiana. Following the completion of the transfer, the clerk is directed to close this action on the docket. Mr. Sanchez's motion for leave to proceed in forma pauperis remains pending to be decided by the judge in the Northern District of Indiana. (Copy to Plaintiff via U.S. mail).
