Order Directing Filing of Complaint and Payment Filing Fee - Plaintiff Jwaun L. Poindexter filed a motion for emergency injunctive relief, a brief in support, and exhibits. However, except for a situation not applicable here, the only way to commence an action in federal court is by filing a complaint. Mr. Poindexter has not filed a complaint. He has filed a motion. Dkt. #1 . This motion is not a proper way to commence a federal court action. If Mr. Poindexter wishes to file a lawsuit, he must file a complaint. In addition, if Mr. Poindexter submits a complaint, he contemporaneously must either pay the $402.00 filing fee or file a motion for leave to proceed in forma pauperis, including a copy of his inmate trust account statement. Failure to take both steps by September 6, 2023, will result in the dismissal of this action without further warning. (See Order.) Signed by District Judge Richard L. Young on 8/2/2023.
