September 6, 2023 Opinion or Order Filing 6 ORDER SCREENING AND DISMISSING COMPLAINT - Pro se plaintiff Andrea White has filed one-page complaint describing untreated pain while incarcerated at Boone County Jail. The complaint does not expressly list a defendant. Though the Court liberally construes the complaint as naming Boone County Jail as a defendant, a jail is not a suable entity. Because the complaint does not state a claim against a suable defendant, it is DISMISSED FOR FAILURE TO STATE A CLAIM UPON WHICH RELIEF MAY BE GRANTED. The dismissal of the complaint will not, at this time, lead to the dismissal of the lawsuit. Instead, the Court will give Ms. White an opportunity to file an amended complaint to avoid dismissal. The CLERK SHALL send Ms. White a prisoner complaint form with her copy of this Order. Ms. White must use this form to file an amended complaint. Ms. White has not paid the $402.00 filing fee. She must pay the filing fee, or file a motion to proceed in forma pauperis, by September 29, 2023. Failure to meet this deadline will result in dismissal of the lawsuit without further warning. The CLERK SHALL send Ms. White a motion to proceed in forma pauperis form with her copy of this Order. Ms. White's motion for court assistance, dkt. #5 , is GRANTED TO THE EXTENT that the Court issues this Order. In all other respects, it is DENIED WITHOUT PREJUDICE. (See Order.)
