ENTRY DISMISSING ACTION WITH PREJUDICE: Puckett's claims for a hate crime and for a violation of his constitutional rights under 42 U.S.C. 1983 are time-barred by the state of limitations.2 His claim for civil assault is barred by res judicata. ENTRY GRANTING #2 MOTION FOR IFP STATUS AND SCREENING COMPLAINT: On August 16, 2023, Plaintiff Leroy Wayman Puckett moved for leave to proceed in forma pauperis. Supporting that motion, he submitted an affidavit detailing his incomes and expenses. (Filing No. 2). Given that affidavit, the court finds Puckett is incapable of prepaying the filing fee. Accordingly, his motion to proceed in forma pauperis is GRANTED. Accordingly, Puckett is hereby ORDERED to SHOW CAUSE why this case should not be dismissed with prejudice for being filed outside the limitations period imposed by the Washington legislature. He shall have until September 14, 2023, to file a response. Should he fail to do so, the court will consider him to have conceded that no facts justify tolling the statute of limitations. See Order.
