Filing 7 Order Dismissing Complaint and Directing Filing of Amended Complaint - Because the Court has been unable to identify a viable claim for relief against any particular named defendant, the complaint is subject to dismissal. The dismissal of the complaint, however, will not in this instance lead to the dismissal of the action at present. In the interest of justice, the Court will allow plaintiff to amend his complaint if, after reviewing this order, he believes that he can state a viable claim for relief, consistent with the allegations he has already made. The plaintiff shall have through February 2, 2024, to file an amended complaint. The clerk is directed to include a copy of the prisoner civil rights complaint form along with the plaintiff's copy of this Order. (See Order.) Signed by District Judge Matthew P. Filing 6 Order on In Forma Pauperis Status - The plaintiff's motion to proceed in forma pauperis, dkt. #2 , is granted. Although the plaintiff is excused from pre-paying the full filing fee, he still must pay the three hundred and fifty dollar ($350.00) filing fee pursuant to the statutory formula set forth in 28 U.S.C. 1915(b)(2) when able.
