ORDER denying 56 Motion as to KENNETH MORGAN ADDISON (1)(1:22-CV-142 JRS-KMB): Kenneth Addison's motion regarding the disposition of seized information seeks relief under Federal Rule of Criminal Procedure 41(g). Dkt. 56. Consistent with United States v. Howell, 354 F.3d 693 (7th Cir. 2004), a new civil action will be opened based on Mr. Addison's motion. 1. The defendant's motion to return property, dkt. 56, will be docketed as the complaint in the new civil action. 2. The docket of the new civil action will show Kenneth Morgan Addison as the plaintiff and the United States of America as defendant. This order will be re- docketed in the new civil action. 3. The nature of suit code for the new action is 540 and the cause of action code is 28:1355. The assignment of judicial officers in the newly opened action will be by random assignment. 4. After the new action is opened and before the government is directed to respond, Mr. Addison will be directed to either pay the $405.00 filing fee or demonstrate his financial inability to do so. 5.
