March 28, 2024 Opinion or Order Filing 9 ORDER DISMISSING ACTION - Tyler Fisher brought this action while in custody at Pendleton Correctional Facility. Dkt. #1 . He did not prepay the filing fee. He moved to proceed in forma pauperis but failed to attach a completed trust account statement as required by statute for prisoners. 28 U.S.C. 1915(a)(2). On February 8, 2024, the Court ordered Mr. Fisher to either pay the filing fee for this action or file a motion for leave to proceed in forma pauperis. Dkt. #8 . Additionally, the Court explained that the complaint did not have sufficient allegations to support federal subject matter jurisdiction. Id. at 2-4. The order gave Mr. Fisher until March 7, 2024 to pay the filing fee or file another motion to proceed in forma pauperis and also to show cause why the case should not be dismissed for lack of subject matter jurisdiction. Id. at 4-5. The March 7, 2024 deadline has passed, and Mr. Fisher has not completed any of the ordered tasks. Accordingly, this action is DISMISSED without prejudice for failure to comply with Court orders. Final judgment in accordance with this Order shall now issue. February 8, 2024 Opinion or Order Filing 8 ORDER - Mr. Fisher's motion to proceed in forma pauperis is DENIED as presented. Dkt. #3 . Mr. Fisher shall have until March 7, 2024, in which renew his motion to proceed in forma pauperis with a copy of a completed trust account statement. Otherwise, he must pay the filing fee. The clerk shall include a form motion to proceed in forma pauperis with Mr. Fisher's copy of this order. Because Mr. Fisher's complaint appears to lack subject-matter jurisdiction, his motion for service is also DENIED. Dkt. #5 . Mr. Fisher shall have until March 7, 2024, to file an amended complaint or otherwise show cause why this case should not be dismissed for lack of subject-matter jurisdiction. The clerk is directed to include a copy of the civil complaint form along with the plaintiff's copy of this Order. See Order. Signed by Judge James Patrick Hanlon on 2/8/2024.
