Filing 8 ORDER - On February 13, 2024, we ordered Plaintiffs to file an amended complaint in order to properly allege the parties' citizenship for purposes of establishing our diversity jurisdiction. Plaintiffs have now filed their amended complaint but have failed to fix any of the deficiencies identified in our prior order. It is the burden of the party seeking to invoke federal jurisdiction to establish that jurisdiction is present. Accordingly, Plaintiffs are given 14 days within which to file a second amended complaint that properly alleges subject matter jurisdiction by including averments as to the citizenship of all the parties. We note, however, that this is twice that the Court has given Plaintiffs instruction on how to properly allege jurisdiction. We are done with our tutorials. Defendant is cautioned, however, that when it does respond to the Amended Complaint, and to the extent that it denies any of Plaintiff's jurisdictional allegations or states that it does not have sufficient information to respond to those allegations, the Court will require the parties to conduct whatever investigation is necessary in order to file a joint jurisdictional statement confirming that all parties are in agreement with the underlying jurisdictional allegations before the litigation moves forward.
