Order Discussing Motion to Reinstate Petition and Directing Opening of New Civil Action - Petitioner Timothy N. Hatton was convicted in an Indiana state court of child molesting in 2013. His petition for writ of habeas corpus pursuant to 28 U.S.C. 2254 to challenge that conviction and sentence was dismissed as untimely on September 30, 2019. He appealed, and the Seventh Circuit denied him a certificate of appealability on July 10, 2020. Now, several years later, Mr. Hatton has moved to reinstate his petition. Mr. Hatton's motion must be treated as a new action brought pursuant to 28 U.S.C. 2254. The clerk is directed to open a new civil action in the Indianapolis Division and re-docket the Motion to Reinstate Petition as Mr. Hatton's petition for writ of habeas corpus pursuant to 28 U.S.C. 2254.
