Order Granting Motion to Proceed In Forma Pauperis, Granting Motion to Amend Complaint, Screening Amended Complaint, and Directing Defendants to Respond - Mr. Teckenbrock's motion to proceed in forma pauperis, dkt. #11 , is GRANTED. He shall have through October 17, 2024, to pay the initial partial filing fee. His motion to amend, dkt. #8 , is GRANTED. The clerk shall re-docket the proposed amended complaint, dkt. [8-1], as the amended complaint. Mr. Teckenbrock's claims against Nurse Michelle and Nurse Practitioner Reynolds are proceeding in this case. Mr. Teckenbrock shall have through October 17, 2024, to notify the Court if he wishes the Court to open a separate case regarding his claims against Deputies Underwood and Smith. Alternatively, Mr. Teckenbrock may file a separate complaint on these claims. Mr. Teckenbrock is reminded that those claims will be subject to the filing fee and screening requirements. The clerk is directed pursuant to Fed. R. Civ. P. 4(c)(3) to issue process to the defendants in the manner specified by Rule 4(d). Process shall consist of the complaint, dkt [8-1], applicable forms (Notice of Lawsuit and Request for Waiver of Service of Summons and Waiver of Service of Summons), and this Order. The defendants shall respond to the motion for a preliminary injunction when they answer the complaint. Nothing in this Order prohibits the filing of a proper motion pursuant to Rule 12 of the Federal Rules of Civil Procedure. ( See Order.) Copies Distributed Pursuant to Distribution List.
