CODE 24-5-22-1 to 10 - On January 16, 2026, Defendant Ulta Salon, Cosmetics & Fragrance, Inc., filed a Motion to Dismiss Plaintiffs' Complaint. [Dkt. #34 .] In that motion, Defendant challenges the constitutionality of Indiana's Deceptive Electronic Mail statute, Ind. Code 24-5-22-1 to 10, under the Dormant Commerce Clause of the United States Constitution. Id. That same day, Defendant also filed a Notice of Constitutional Challenge and served a copy of that Notice on the Indiana Attorney General, in accordance with Federal Rule of Civil Procedure 5.1(a) and S.D.Ind. Local Rule 5.1-1(a). [Dkt. #36 .] Pursuant to 28 U.S.C. 2403(b), the Court hereby certifies the constitutional challenge to the Indiana Attorney General and permits Indiana to intervene for presentation of evidence and for argument on the question of constitutionality. Indiana "shall, subject to the applicable provisions of law, have all the rights of a party and be subject to all liabilities of a party as to court costs to the extent necessary for a proper presentation of the facts and law relating to the question of constitutionality." 28 U.S.C. 2403(b). Indiana's deadline to intervene in this action is March 17, 2026. See Fed. R. Civ. P. 5.1(c) ("Unless the court sets a later time, the attorney general may intervene within 60 days afterthe notice is filed or after the court certifies the challenge, whichever is earlier.").
