Filing 19 ENTRY Dismissing Claims and Directing Further Proceedings; For reasons explained in this Entry, legally insufficient claims must be dismissed, while remaining claim will proceed. Furrow's due process claims asserted pursuant to Fifth Amendment a re dismissed. BOP and official capacity claims are dismissed. Claim that BOP's policy stating that "inmates who are housed in segregation, special housing, or jail units for less than a 12 month period will have access to dent al triage and emergency care only" is unconstitutional is dismissed for failure to state a claim upon which relief may be granted and is dismissed. Claims against defendants Beighley, R. Shepherd, FCC Warden, Regional Dental Consultant, and BOP Chief of Dental Programs in their individual capacities are dismissed medical care. No partial final judgment shall issue at this time as to claims resolved in this Entry. Claim which remains following the screening required by 28 U.S.C. § 1915A (b) is individual capacity claim against defendant S. Wells. Clerk is designated to issue process to defendant S. Wells. Marshal for this District or his Deputy shall serve the summons, together with a copy of complaint, filed on March 10, 2010, and a copy of this Entry, on defendant and on officials designated pursuant to Fed.
