Filing 26 AMENDED ENTRY DISCUSSING PETITION FOR WRIT OF HABEAS CORPUS AND DENYING CERTIFICATE OF APPEALABILITY - Presently pending before the Court is Petitioner Jeffrey Washington's Petition for a Writ of Habeas Corpus. 1 For the reasons explained h erein, the Court finds that Washington's petition for a writ of habeas corpus must be denied and the action dismissed with prejudice. In addition, the Court finds that a certificate of appealability should not issue. Amended Judgment consistent with this Entry shall now issue. The Court denies a certificate of appealability. Filing 21 ENTRY DISCUSSING PETITION FOR WRIT OF HABEAS CORPUS AND DENYING CERTIFICATE OF APPEALABILITY - Presently pending before the Court is Petitioner Jeffrey Washington's Petition for a Writ of Habeas Corpus. [Dkt. 1.] Washington raises three issu es, but the Court concludes that he has procedurally defaulted on two of them by not presenting them to the state court on postconviction review. The Court rejects Washington's claim for ineffective assistance of trial counsel on the merits. For these reasons, explained in further detail herein, Washington's petition for a writ of habeas corpus must be denied and the action dismissed with prejudice. In addition, the Court finds that a certificate of appealability should not issue. Judgment consistent with this Entry shall now issue. (See Entry.) Copy to petitioner via US Mail. Filing 4 ENTRY AND ORDER TO SHOW CAUSE - Plaintiff's motion for appointment of counsel 3 is denied. The petitioner's custodian, named in his official capacity only, is substituted as the respondent in this action. The petitioner's custodian is directed to answer the allegations of the petitioner's petition for a writ of habeas corpus, and in doing so shall show cause why the relief sought by the petitioner should not be granted. This shall be done within twenty (20) days after the date this Entry is docketed.
