Filing 180 ORDER granting in part and denying in part Defendants' 151 Motion for Summary Judgment. Odom has not identified a genuine issue of material fact as to his claims against Dr. Talens and Nurse Gray and these defendants are entitled to judgme nt as a matter of law. Nurse Flener (like Dr. Talens and Nurse Gray) is also entitled to summary judgment on Odom's state law claims. No partial final judgment shall issue at this time as to the claims resolved in this Entry. The motion for s ummary judgment is denied as to the Eighth Amendment claims against Nurse Flener. Accordingly, the Eighth Amendment claims of deliberate indifference and excessive force shall proceed to trial against Nurse Flener. These claims are based on the allegation that Nurse Flener twisted Odom's fractured finger in anger on March 15, 2011. A pre-trial scheduling order will be issued in the near future.
