Filing 10 ENTRY DISCUSSING PENDING MOTIONS, SCREENING AMENDED COMPLAINT AND DIRECTING ENTRY OF FINAL JUDGMENT - The motion for leave to proceed in forma pauperis [dkt. 8] is granted. The assessment of even an initial partial filing fee is not feasible at th is time. The motion to amend complaint [dkt. 9] is granted. The amended complaint filed on November 8, 2013, is the operative complaint. The amended complaint fails to survive the screening required by Sec. 1915A, because it fails to state a cl aim upon which relief can be granted. Dismissal of the action pursuant to 28 U.S.C. Sec. 1915A(b) is therefore mandatory and judgment consistent with this Entry shall now issue. (See Entry.) Copy to plaintiff via US Mail. Signed by Judge William T. Lawrence on 11/14/2013. (RSF) |
