The Court finds that Plaintiff is entitled to attorney's fees and costs for his Motion to Compel in the amount of $10,532.75. As such, the Magistrate Judge recommends Plaintiff's Motion for Attorney's Fees [Dkt. 204 ] be GRANTED IN PART and DENIED IN PART, and that Plaintiff be awarded fees and costs in the total amount of $10,532.75. Defendant shall provide a complete and unequ ivocal response to Interrogatory No. 3 and produce all documents responsive to Request for Production No. 37 within ten days of the date of this Order. Once the required information is produced, Defendant shall re-produce Lynn Prindes for deposition if requested by Plaintiff; Defendant is precluded from imposing any limitations upon the scope of such deposition (SEE ORDER FOR ADDITIONAL INFORMATION). September 15, 2016 Opinion or Order Filing 117 ENTRY REGARDING ATTORNEY DISQUALIFICATION - The issue before the Court is whether attorney G. John Cento should be disqualified from representing the Plaintiff in this case brought under the Fair Credit Reporting Act ("FCRA") because he previously represented the Defendant, Trans Union LLC, defending it in numerous FCRA cases. The issue has been extensively briefed by the parties, and the Court has held a hearing on the matter. The Court, being duly advised, now finds that Cento i s not disqualified from representing the Plaintiff in this case. Given the lack of factual overlap between the cases litigated by Cento on behalf of Trans Union and the passage of time that has rendered any confidential strategic or general knowledge acquired by Cento during his representation of Trans Union obsolete, the Court finds that Cento may represent Watkins in this case. January 28, 2016 Opinion or Order Filing 102 ENTRY ON OBJECTIONS TO MAGISTRATE JUDGE'S ORDER - Trans Union's objections to Magistrate Judge Hussmann's ruling are OVERRULED. The parties shall work together to schedule the depositions of Schuckit and Norris to take place as soon a s possible. Trans Union shall respond fully and completely to Watkins' document requests within 14 days of the date of this Entry. The hearing on this matter is reset for Friday, March 11, 2016, at 9:30 a.m., in Room 202, United States Courth ouse, 46 E. Ohio St., Indianapolis, Indiana. The Court urges counsel in this case to put aside their differences and cooperate in completing this discovery and to consider carefully the merits of any invocation of privilege and any challenge to such.
