July 6, 2015 Opinion or Order Filing 43 ORDER denying 37 Motion to Intervene. Petitioners generally allege that they have personally witnessed discrimination against unnamed Muslim prisoners in an array of contexts "in other Federal prisons and State prisons nationwide." [Fi ling No. 37 at 1.] Petitioners' general allegations are not enough to demonstrate a shared question of law or fact with Mr. Lindh's claim at issue in this litigation. January 14, 2015 Opinion or Order Filing 27 ORDER denying 6 Motion to Certify Class. It is undisputed that Mr. Lindh has been disciplined for wearing his pants above his ankles, but that only two of the 45 declarants assert that they have also been disciplined for violating the policy a t issue. Thus, it is possible that Mr. Lindh may be entitled to certain relief that most other putative class members are not. For these reasons, the Court concludes that certification under Rule 23(b)(2) is inappropriate. The Court requests that the assigned Magistrate Judge set a case management conference with the parties.
