Filing 117 FINDINGS OF FACT AND CONCLUSIONS OF LAW - Plaintiff Timothy Poff brought this lawsuit alleging that Defendants Quick Pick, LLC ("Quick Pick") and Ahmed Shaker failed to pay Mr. Poff his required minimum wage and terminated him in retalia tion for filing this lawsuit, in violation of the Fair Labor Standards Act ("FLSA") and state law. Quick Pick, LLC was defaulted for failure to plead or otherwise contest Mr. Poff's allegations. Mr. Poff's claims against Mr. Sh aker proceeded to a bench trial, which was held on November 13, 2018. The Court concludes that Mr. Shaker is entitled to judgment in his favor on Mr. Poff's Amended Complaint. Final judgment will issue accordingly. (See Entry.) Filing 106 ENTRY - For the foregoing reasons, the Court concludes that the remaining issue for the November 13, 2018 trial is Mr. Shaker's individual liability under the FLSA, IMWL, and IWPS. This includes Mr. Shaker's personal liability for any retal iation under the FLSA which was not at issue, and therefore not actually litigated, at the damages hearing. However, the issue of damages and the facts concerning Mr. Poff's hours worked and wages paid were conclusively established by the Court& #039;s earlier findings following the damages hearing during which Mr. Shaker participated by counsel, and will not be relitigated at the upcoming bench trial. Poff is entitled to default judgment against Quick Pick, LLC, on his claim under the FLSA and is entitled to recover $18,123.48 in compensatory and liquidated damages, plus his reasonable attorney's fees and costs. Although Defendant Quick Pick, LLC, appeared at the hearing on this matter and offered no just reason for delay in entering partial judgment, the Court hereby Orders Quick Pick, LLC, to SHOW CAUSE on or before May 12, 2017, why the Court should delay in entering partial judgment pursuant to Federal Rule of Civil Procedure 54(b) (SEE ORDER FOR ADDITOINAL INFORMATION).
