Filing 50 ORDER granting in part and denying in part 38 Motion for Summary Judgment and Directing Further Proceedings - Defendant Dr. Byrd is entitled to summary judgment on Mr. Mendoza's claims of deliberate indifference. Defendant Nurse Knust is enti tled to summary judgment on all claims against her except that she delayed making sure that Mr. Mendoza was provided pain medication on the date of his injury. Accordingly, the defendants' motion for summary judgment, 38 , is granted in part an d denied in part. No partial final judgment shall issue at this time. The Magistrate Judge is requested to set this matter for a status conference and settlement conference in an effort to resolve the remaining claim against Nurse Knust. SEE ORDER.
