Filing 245 Entry Granting Defendants' Unopposed Motion for Summary Judgment - Mr. Gaines has failed to present any evidence that would create a genuine issue of material fact as to his claims against the Defendants in this action. The Defendants have submitted undisputed admissible evidence showing that they are entitled to judgment as a matter of law. The unopposed motion for summary judgment filed by the Defendants, dkt. 230 , is granted. Final judgment shall issue consistent with this Entry and with the screening Entry, dkt. 11 , the stipulation of dismissal and termination of some defendants, dkt. 141 , dkt. 151 , dkt. 174 , dkt. 204 , and dkt. 219 , and a prior summary judgment ruling, dkt. 244 . Filing 11 Entry Screening Amended Complaint, Dismissing Insufficient Claims, and Directing Service of Process - Plaintiff Deangelo Gaines ("Mr. Gaines"), an inmate at the Putnamville Correctional Facility ("Putnamville"), brought this acti on on April 25, 2016, pursuant to 42 U.S.C. § 1983 against Corizon Health ("Corizon") and a number of individual defendants. He alleges that the defendants were deliberately indifferent to his serious medical needs, retaliated again st him, denied his equal rights, and violated his rights under the Americans with Disabilities Act ("ADA") and Rehabilitation Act ("Rehab Act") during his incarceration at Putnamville. His constitutional claims are brought under the First, Eighth, and Fourteenth Amendments to the United States Constitution. He filed an amended complaint on June 8, 2016. No partial final judgment shall issue at this time as to the claims that are dismissed in this Entry. With the change i n defendant in Claim 4 noted in Part I. C. above, Claims 1 through 4 shall proceed against the named defendants. The clerk is designated pursuant to Fed. R. Civ. P. 4(c) to issue process to the defendants numbered 1 through 19 and the Indiana Department of Correction in the manner specified by Rule 4(d). (See Entry.) Filing 5 Entry Granting In Forma Pauperis Status, Discussing Complaint, and Directing Plaintiff to File Amended Complaint - The plaintiff's motion to proceed in forma pauperis 1 is granted. The assessment of an initial partial filing fee is not feas ible at this time. Notwithstanding the foregoing ruling, the plaintiff still owes the $350.00 filing fee. A large portion of Claim 1 is time-barred. The allegations in Claim 1 are not clear, however, as to who denied Mr. Gaines' request s for a seizure helmet after April 25, 2014. The Court will not direct service of process until it is more clear which defendants personally participated in wrongdoing during the relevant time period. Mr. Gaines shall have through June 15, 2016, in which to file an amended complaint. (See Entry for additional information.) Copy to plaintiff via US Mail. Signed by Judge William T.
