February 11, 2019 Opinion or Order Filing 91 Order Granting Motion for Summary Judgment and Directing Entry of Final Judgment - Because Mr. Troya has not identified a genuine issue of material fact as to his claims in this case, and because he did not suffer from a serious medical condition, and/or because his condition was not disregarded by the defendants, the defendants are entitled to judgment as a matter of law. Therefore, the defendants' motion for summary judgment, dkt. 72 , is granted. Judgment consistent with this Entry shall now issue. (See Order.) Copy to Plaintiff via U.S. Mail. September 24, 2018 Opinion or Order Filing 84 Order Denying Motion to Reconsider - The plaintiff, Daniel Troya, has filed a motion to reconsider the 76 Court's Entry dated July 23, 2018, that denied his fourth motion for counsel. The Court continues to conclude that Troya is able to com petently litigate whether the defendants followed Union Hospital's post-operative instructions. The Court will appoint counsel if Troya survives summary judgment. The plaintiff's motion to reconsider, Dkt. No. 81 , is denied. (See Order.) Copy to Plaintiff via U.S. Mail. April 12, 2017 Opinion or Order Filing 5 Entry Discussing Complaint, Dismissing Insufficient Claims, and DirectingService of Process - The plaintiff's motion to proceed in forma pauperis, dkt. 2 , is granted. He is assessed an initial partial filing fee of Eight Dollars and Ninety-Tw o Cents ($8.92). He shall have through May 12, 2017, to pay this sum to the clerk. In summary, Mr. Troya's claims for monetary damages against Dr. Wilson, Susan Porter, Heather Mata, Cindy McGhee, and Michael Rumska shall proceed. Hi s claims against John Doe, Nurse, are dismissed, and his claim for a declaratory judgment is dismissed. The clerk is designated to issue process to the United States. Process shall consist of a summons. The Marshal for this District or his Deputy shall serve the summons, together with a copy of the complaint, filed on April 10, 2017, (Dkt. 1), and a copy of this Entry, on the defendants at the expense of the United States(See Entry).
