Filing 4 Entry Dismissing Petition for a Writ of Habeas Corpus - Because Mr. Escobar's claims are based only on the suspension of the phone privileges and not on the fact or duration of his custody, he has failed to state a claim for habeas relief. For this reason, this action is dismissed. In dismissing this habeas petition, the Court notes that Mr. Escobar may choose to file a civil rights action that raises the claims in his petition. Mr. Escobar is notified that the Court is not deciding the ultimate merit of such case. In addition, if Mr. Escobar files a civil rights lawsuit, that lawsuit will be subject to the $400 filing fee and the screening requirement of 28 U.S.C. 1915A.
